Our decades of experience have convinced us that there is often a no man's land between technical experts and attorneys. Neither is familiar with the evidentiary standards for technical evidence in the specific litigation at hand. Bardwell Consulting was formed to bridge this gap. To this end, we provide specialized legal consulting for attorney's to handle the challenges of technical evidence.

Our in-house litigation support team can work with you independently of your expert witness, to provide the analysis and guidance you need to use expert witnesses effectively and meet the evidentiary requirements of your case. Because the need for and best use of an expert witness isn’t always apparent to attorneys approaching their case from a legal perspective, we encourage attorneys to contact us for a consult at or before the start of a case. Our legal staff assists attorneys in navigating the interface between the law and quantitative and scientific evidence.

These services can start as soon as litigation is considered, by ensuring that all claims supported by quantitative evidence are included in the complaint. Our legal team can also define the evidentiary standards that quantitative evidence must meet, which is essential for developing discovery that demands all necessary data, and defining the burden of proof that is required. Finally, our legal team can aid in navigating evidentiary issues during settlement negotiations and mediation. 

The crux of the problem is this: attorneys, judges, and juries aren’t scientists, and scientists aren’t legal experts. Most attorneys don't have the specialized knowledge and experience to know what evidence is needed or available, and many experts don't know how to contribute what attorneys actually need. Good attorneys and good experts can turn out bad product when neither understands the relationship between scientific evidence and the law, and the requirements of presenting complex quantitative evidence at trial.

This is where we come in: we help attorneys identify where a technical or scientific expert can strengthen their case and provide qualified experts that are able to present effectively in a legal setting. We also help attorneys understand the unique requirements for presenting scientific evidence in a legal environment.
